That incident right there could be a reason for how closures can happen.
BNRR will automatically fine you $500 and can prosecute you in court for crossing railroad tracks or just being too close to the railroad tracks if they catch you or can identify you via a photo .
The train operators are also required to document any close calls they have with people. This is usually how the develop their database on problem locations and can result in changes being made (or shutdowns occurring) at those locations.

That was the point I was trying to make these closures are not targeted at kiteing. anytime a illegal railroad crossing get to much traffic the railroad will get the law that already exists enforced. The coves east of secret spot were The Dalles locals swiming spot.

Who owns the land on the east side of the river? Is there any chance of access from those bushes? I know that there is a RR crossing in town that takes you to the east bank of the river.

I LOVE LYLE !!!!

I was talking to my neighbor in White Salmon last night, and he was saying how him and his wife like going down the the sandbar and bouldering by the river / under the bridge. When I mentioned the closure possibility he got pretty upset.

These people aren't kiters they are just locals who want access to the river and beaches. Seems like it would be easy to get signatures at least from these folks to show that there is a local contingent besides kiters that wants to preserve access.

Just some random thoughts...

Hopefully something can be worked out, has the CGKA spoke to anyone yet? ON a certain level, its pretty phucked that the RR can build its tracks down the entire gorge and then tell people they can't access the river by crossing their tracks.

I put in some calls to WDOT & BNSF this morning, and I am waiting for them to get back ahold of me.

The tracks didn't just magically appear in the last decade, thay have been there for a long time, and the economical value of the transportation line, is considered very valueable by local govenrment officials

The river is commerce, and the Railroad owns the land the tracks are on, plus a set back, this is one of those VERY old things.

If it was your property, would you open up the path to the public, or would it turn into a private launch?

The point here is that the access to the river is limited, and it does in deed suck, but where we can go out of our way to ensure the launch is saved and even look after the local kids even. It's not hard for me to tell someone not to do something that is both dangerous and illegal.

They are not going to want their parents paying a 500 dollar fine Shocked That could be very painful and mean not sitting for a long time, this is the sticks you know.

Anyway, Walk under the bridge, that is the best solution, probably don't have to cross the highway either, that will make WSP happy too.

The fishermen get to access the white salmon by going underneith.

A chainlink fence is inevietable there in Lyle, just like on the white salmon.

I spoke to the WDOT and I was told that the BNSF railway had pushed back their right of way, and the WDOT was putting in a guard rail which would eleminate some parking, but they have no plans to shut down access.

I have a call in to the RR, and will follow up with them.

Good info, thanks for the research! Can you clarify what you mean by "pushed back"? Do you mean pushed back time-wise to a later date? Or pushed the boundaries of the right of way "back" towards the road? Or something else?

No time lines were pushed back, somehow the Railroad got a little more real estate.

I also spoke to a guy at BNSF who apparently is in charge of that area of tracks, and he had no information about access issues. He, however, said that the RR always has the right to charge people with trespassing anytime railroad tracks are crossed.
