to the administrators of nwkiteforum. You have , using confidential information(I.E. my real name) which I did not make public or authorize YOU to utilize in any way not appropriate, gone on the web and located a photo of me; then also without my permission, posted it as my avatar on this forum.
You have done this out of spite and prejudice and in violation of my rights. Take it down immediately and I may consider not suing you. You may not choose to take responsibility for what you say/allow...but you can be made to take responsibility for what you do.
I have copied the page of my latest topic/replies for proof, and by that have further reason to take action against you . Take it down. Now.

PUBLISHING PHOTOS FOUND ON INTERNET DID NOT INVADE NAVY SEALS' PRIVACY
The Associated Press did not invade the privacy of four Navy commandos by publishing photographs of them subduing and detaining prisoners in Iraq, a California federal court recently ruled. (Four Navy SEALs v. Associated Press, July 12, 2005.) An AP reporter downloaded the photos from an Internet Web site. This decision extends to the Internet the principle that gathering and publishing information that is already public is not an invasion of privacy.
In the process of investigating a story in December 2004, AP Reporter Seth Hettena used an Internet search engine to look for Web sites that included the name of a Navy camp in Iraq. One of the Web sites the search returned was a page on a commercial photo storage-and-sharing site that contained numerous pictures of SEALs conducting operations. The page was part of the account the wife of a SEAL maintained on the photo site.
Hettena found several photographs on the Web site of SEALs with Iraqi detainees. They included some in which the SEALs appeared to be mugging for the camera, others that showed SEALs sitting on detainees, and a few that depicted SEALs pointing a gun at a prisoner's bloody head.
Although the wife of the SEAL uploaded the photographs to the Web site believing they could be accessed only with a password, Hettena was able to find, view and download them without one. AP then published a report about potential abuse of Iraqi prisoners by SEALs accompanied by 13 photos. The article did not name the SEALs, whose identities are normally kept secret by the Navy, but AP did not black out their faces in the photos.
Four of the SEALs and the woman who uploaded the photos sued AP for invasion of privacy, alleging that publishing the photos endangered their lives. A California federal trial court, however, dismissed their claims.
The SEALs did not have a reasonable expectation of privacy in this situation, the court concluded, because they took photographs of their activities and allowed those photos to be placed on a publicly accessible Web site. In general, there is no privacy for information already in the public domain, and the court said that this includes information posted on the Internet. The court added it was irrelevant that the plaintiffs intended only that a few people would have access to the Web site.
Similarly, the court said that AP did not invade the privacy of the SEAL's wife by viewing the unprotected Web site and downloading the photos. "Conducting an internet search and downloading photographs … are acts that do not rise to the level of exceptional prying into another's private affairs," the court said.
As journalists increasingly gather information on the Internet, courts are facing more questions about whether the press can be liable for those activities and news generated by them. The result of this case -- that publicly accessible information on the Internet cannot form the basis of a privacy claim -- is a hopeful sign that courts will extend traditional press protections to this medium.
If the courts found the press not guilty for publishing the faces of Navy seals that the Navy keeps confidential, I highly doubt that you have a case of someone googeling your name and finding your picture. |

personal names are provided to forums in legal confidence...the only way my photo was obtained was by misusing that confidence to locate the photo and then spitefully and without my permission post it. NWkiteforums was spiteful and prejudiuced in this in that it is NOT common practice for them to use these methods and tactics to post photos of members who have not themselves made their names publicly available in that forum. Again...NWkiteforum could only get my photo by misusing information given them in confidence. There you go kiddies...do you get it NOW?
Juries award based on combinations of factors and I do not worry at all about proving not only the legal points of what I have said but the prejudicial and spiteful spirit at nwkiteforums to do so. Backed up by the general rules oif conduct which they neither enforce.

Wow, I usually keep my head low on this forum since I am such a newbie and really don't know anything about kiteboarding...
But this dude just has got me cracking up and I just had to waste a few minutes and search out his posts to try and get a better understanding. Dude, you got all your gear yet? I noticed you still looking for a board early this month? Man, between you and that Bulae99 guy I should have this sport figured out in a few days.

if nothiong else...along with these comments...it at least proves there are one LOT of punks at nwkbf. PLEASE...put YOUR pix up...so I will know YOU when I meet YOU. Few of you have...nor has NWKBF disrespected you by doing so. This not just an issue of what nwkbf did...but WHY they did it.
I wonder what kites I will buy with my lawsuit/damages!????? Bam Bam... aka Jon Malmberg... Kiter since 2000, working in the industry as a designer... Third at BOTG in the Maters this year...
Still consider myself having a lot to learn as the new school kids are killing it...
Maybe you should do a little research yourself on the local community that you are making no friends in. Personally I doubt we will ever meet since I would not show your face at any of the local riding spots after your behaviour on this forum...
By the way, we don't need images of ourselves posted since we all know, ride, and respect each other on the water... You had better grow some thicker skin because on this forum we still can get pretty tough on dumb comments, even if they are coming from our friends.
Good luck with you kiting career in the NW, and at least if you ever come to Maui I know what you look like and will be kiting as far away from you as possible...
